Associate General Counsel, Director (Construction) supports the company’s legal operations in a variety of matters, with a focus that includes construction, project development, energy procurement and utilities. The position provides support to the company’s development operations and other business units. Experience with large scale construction and/or power projects is preferred.
This position will reside in one of our key people centers: Overland Park, KS; Irving, TX; Richmond, VA; Duluth, GA; Ashburn, VA
RESPONSIBILITIES, other duties may be assigned
Oversee legal aspects of the company’s construction and procurement contracting terms and process; work with the company’s Development team in negotiating and managing construction contractsOversee legal aspects of the company’s energy / utilities procurement program (including renewables); work with the company’s Development team to secure power and utilities to the company’s projectsAdvise on regulatory matters regarding energy and utilitiesAdvise on regulatory, health and environmental matters regarding development projectsNegotiate and work with the company’s contractors and utility providersNegotiate and structure project-related documents, including vendor / supply agreements, O&M agreements, offtake agreements and other similar agreementsSupport project financing transactionsAssisting with a variety of other legal matters such as regulatory matters, permitting, environmental, due diligence and real estate, as well as various other transactional matters and agreements as neededWorking with and managing outside counsel, partners, customers, counterparties and other third parties, as neededPerforming a broad range of legal matters and general business matters based on the needs of the company, as may be assigned by the General CounselBASIC QUALIFICATIONS
J.D. from an accredited U.S. law school with strong academic credentialsAdmission to the Bar of a U.S. state or the District of ColumbiaSeven or more years of legal experience as a practicing lawyer working in the area of design, engineering, and construction contracting (representing contractors, owners and developers)Legal experience with, or willingness to learn, regulations and contracting for energy and utilities procurement and/or power or power-related projects.KNOWLEDGE, SKILLS, AND ABILITIES
