Job Duties: Manage the legal functions of our transportation-focused start-up company and create, track, and manage the Legal Department budget within areas of responsibility. Advise internal stakeholders in the areas of litigation, data privacy & security, regulatory compliance, labor & employment (OSHA, Title VII, ADA, FMLA, ERISA and NYLL), product development, IP disputes, tax law, and insurance. Report to Company’s VP, Corporate Development & General Counsel on a regular basis identifying key performance indicators and outcomes in the AGC’s areas of responsibility. Oversee and provide guidance to the company’s Sr. Legal Operations Associate, assigning and prioritizing the workload. Directly manage outside counsel, insurance brokers, and other vendors servicing the AGC’s areas of responsibility throughout all the company’s locations, including New York, California, and Illinois. Resolve legal issues that arise in connection with the Company’s rideshare service including the drafting of lease agreements and user terms, and accident response procedures and claims. Advise on issues involving the New York City Taxi & Limousine Commission (TLC), technology and app-based issues, and responding to and resolving customer complaints. Requirements: JD, LLM or foreign equivalent degree; plus 5 years of experience in the position offered or as an employment lawyer working in the area of employment and labor law, including working with claims under Title VII, ADA, FMLA, FLSA, ERISA and NYLL, and advising on employment contracts, workplace policies, complaint investigations and employee training. Must have 3 years of experience as an attorney: + Working as in-house counsel at a transportation-focused company with at least 200 employees and a majority of hourly employees; + Working as in-house counsel at an early or growth stage (Series A, B, C) startup company; + Working directly with HR and operations professionals on employee handbook and related employment policy drafting, investigations, accommodation requests, litigation response, defense and settlement, immigration, wage & hour issues, and performance management; + Advising on employee tax issues, including with respect to remote workers; + Advising on labor and unionization issues; + Advising on workplace safety issues, OSHA compliance, and responding to law enforcement citations and subpoenas; + Advising internal customer support function on consumer issues and complaints; and + Advising on legal issues related to the provision of for-hire vehicle services regulated by the Taxi & Limousine Commission (TLC) of New York City. Must be admitted to practice law in the State of New York. Must visit Company’s locations in Bed-Stuy (Brooklyn) and Long Island City (Queens) as needed, approx. eight times per month. Compensation and Benefits Base compensation for this role is $235,031.84 per year.
