Claim Litigation Specialist

Summary

This role is focused on technical claim handling for Accident & Health Chubb insureds nationwide. In this role you will manage complex coverage issues stemming from non-litigated and/or actively litigated claims. Specialist will be responsible for investigating and evaluating coverage for all potential policy exposures (local and global), establishing appropriate reserves, and developing litigation strategies and disposition plans. Specialist will work closely with any internal and external attorneys to develop appropriate investigation of damages, establish a litigation budget, and effectively manage the claim to best possible outcome for Chubb. You will represent the Company at meetings with management and business partners, as well as at mediations, arbitrations, settlement conferences, and trials. This position will require some travel, as well as coordinating with and servicing both internal and external business partners.

Responsibilities

Handle and provide oversight for all complex, litigated, and coverage A & H claims.  Provide outstanding customer service and work well with the insured, internal and external attorneys, brokers and/or TPAs. Coordinate policy benefits with other claims offices in other countries, if applicable  Analyze coverage and communicate coverage positions, as warranted, with various leaders, business units ,and insureds, as applicable.  Conduct, coordinate, and direct investigation into loss facts and coverage⎯ Direct and closely monitor assignments to experts and defense counsel.  Evaluate information on coverage, liability, and damages to determine the extent of exposure to the insured and the company.  Set reserves within authority or makes claim recommendations concerning reserve changes. Travel to conferences, mediations, and trials, as necessary. Travel ranges from approximately 15%to 25%, but it could be more as dictated by business needs.  Track specific litigation trends and provide necessary exposure analysis and findings to senior leadership and business unit.  Actively participate in and coordinate ERISA training and appeals reviews.  Assist with the training and development of litigation management for claims trainees.  Manage and oversees complaints from DOI, OGA, and BBB.  Review and approve subpoenas and waiver of liens.

Qualifications

Heavy litigation experience required.Technical knowledge of Accident & Health, Workers Compensation or General Liability claim handling required.7 or more years’ experience as a claim professional or attorney with a high degree of specialized and technical competence in the handling of high exposure claims. Well versed in investigation techniques. Strong negotiation and communication skills. Ability to write about legal matters in a concise way. Ability to manage claims in multiple jurisdictions.  Strong background and demonstrated ability in dealing with significant coverage matters, including Additional Insured analyses. Ability to properly assess liability and identify third party liability or subrogation opportunities An understanding of the tenants of insurance and legal principles. Working knowledge of industry best practices and procedures. An ability to work independently and assimilate learning materials on many different subjects from various sources. Excellent interpersonal communications and negotiation skills; and an ability to deal with customers and business partners in a professional manner. Ability to make prompt, intelligent decisions based upon detailed analysis of complex issues. Demonstrated strong relational skills particularly in adverse or high-pressure situations. A law degree is not necessary, but recommended.
