Job Description

The Corporate Counsel, Customer Experience and Marketing is responsible for legal support of all aspects of Hertz’s initiatives as they relate to customer interactions, marketing initiatives, advertising compliance and brand protection in the Americas (primarily the US and Canada).  This full-time position reports to the Vice President, Chief Counsel, Operations & Strategy and is based in Estero, FL or Atlanta, GA. Subject to business needs week-to-week, the position is staffed in the office Monday through Thursday and works remotely on Fridays.

By delivering pragmatic, business focused and risk-based legal counsel and guidance in support of key initiatives, this role will play an integral role in executing the company’s strategy to enhance customer loyalty, build brand trust, and drive sustainable growth.

The starting salary is $110K; commensurate with experience

What You’ll Do:

Provide guidance and advice to internal stakeholders (e.g., Commercial Strategy, Customer Experience, Marketing, Product Development, Revenue Development and Operations teams) on all matters relating to customer experience, the marketing funnel, and payments issues, including compliance with consumer-facing laws and regulations relating to e-commerce, unfair and deceptive acts and/or practices laws, data privacy, advertising, credit reporting, debt collection, electronic payments, customer loyalty programs, the Telephone Consumer Protection Act, the CAN-SPAM Act, other applicable laws at the state and federal level, as well as payment card network rules. Oversee management of the company’s global trademark portfolio including registrations, renewals, disputes, infringement and strategy. Review and approve marketing campaigns, promotional materials, and advertising copy to ensure compliance with legal and regulatory requirements. Collaborate with the customer experience team to ensure all customer communications and interactions are transparent, fair, and compliant with consumer protection laws.  Mitigate legal and financial contractual risks, ensuring fair, favorable, and consistent terms across agreements.  Update agreement forms as necessary to reflect changes in relevant laws, regulations, guidelines, and best practices.  Negotiate, draft, review and analyze contracts with influencers, advertisers, spokespersons marketing agencies, and sponsorship partners; and counsel the business on contract interpretation. Translate legal requirements into functional business requirements and assist impacted teams with implementation by preparing and communicating written and oral summaries, guidance documents, corporate policies, training materials and operations procedures to support legal / regulatory compliance and mitigate risk. Manage outside counsel billing and other invoicing, using the Legal Department’s matter management and bill paying technology tools. Deliver business-oriented legal counsel in a timely, positive, collaborative and constructive manner. Assist with other matters as needed. Be a vocal advocate and champion for Hertz’s culture of adhering to strong ethical standards.

 

What We’re Looking For:

J.D. with strong academic credentials.  Required to be admitted to the bar and in good standing in Florida or admitted to the bar and in good standing in another jurisdiction and eligible for limited licensure of in-house counsel in Florida. 3 or more years of commercial transaction, consumer, and marketing experience in a law firm, corporate law department, or government entity.  Knowledge of and experience with advertising, consumer protection, intellectual property and privacy laws at the US federal and state level as well as the applicable regulators (e.g., Federal Trade Commission, Consumer Financial Protection Bureau, and state attorneys general.)      Direct experience with the rental car or general travel industry preferred. Excellent oral and written communication skills; able to effectively explain complex legal issues to non-lawyers. A self-starter; must possess discipline to independently follow up on matters and to work in a fast-paced environment with a high level of autonomy. Must be well organized, detail oriented, and able to manage numerous projects and conflicting demands in a fast-paced environment. Must be able to cooperatively work with Hertz’s management, colleagues in the legal department, internal stakeholders across multiple functions, and outside counsel. Strong interpersonal skills. Ability to balance legal risks with business objectives. Excellent business judgment and an ongoing curiosity about how their work fits into the bigger picture. Exceptional customer service skills. Ability to use Microsoft Office Suite, matter and document management systems, Oracle, and other customary legal software tools. Ability to read, write, and fluently speak and understand the English language
