DESCRIPTION : This is professional services work providing legal counsel, advice, and assistance to the Worker Advocate Division; full legal representation to injured workers served by the Augusta Advocate Division, but with a caseload of comparatively fewer clients than Division Advocates carry; and day-to-day managerial oversight to ensure proper provision of legal services as required by statute. The Deputy Senior Staff Attorney assists the Senior Staff Attorney and may provide legal services to injured workers in complex cases. Work is performed under limited supervision.
REPRESENTATIVE TASKS : (A position may not be assigned all the duties listed, nor do the listed examples include all the duties that may be assigned).
+ Assists in m anag ing day-to-day operations of the A dvocate D ivision and helps determine the course of Division’s operational activity.
+ Answers legal questions from A dvocate D ivision staff, injured workers, and the public in order to ensure compliance with laws, rules, regulations, and procedures.
+ Provides legal counsel and representation on the most complex and sensitive cases for injured worke rs in administrative hearing s and before the Board’s Appellate Division and the Law Court.
+ Directs staff assignments, work schedules, training, and functional activities to ensure work is accomplished in a timely manner.
+ Researches and interprets statutes and case law in order to prepare legal memoranda and appellate briefs.
+ Confers with the Senior Staff Attorney and other senior staff at the Board in order to advise on and monitor legal matters and agency policy.
+ Interviews, hires, evaluates, supervises, disciplines, and coaches subordinate employees in investigating claims of injured workers to ensure that representation of clients meets high standards and established goals.
+ Drafts and recommends new and revised policies, rules, and regulations for review by the Senior Staff Attorney and Executive Director.
+ Assists with preparation and testimony for presentation to the legislature and administrative proceedings.
+ Speaks at seminars and conferences and before the public to explain applicable laws, functions, mandates, and system operations and changes.
+ Provides legal advice and assistance to injured workers in complex or sensitive cases in order to ensure appropriate representation and to protect injured workers’ rights.
+ Implements and complies with human resource laws, policies, procedures and practices such as: AA/EEO, recruitment, employment, position classification, performance appraisals, training, discipline, contract administration, human resource components of security protocols of agency information security and confidentiality policies, and employee safety.
+ Will ensure continuity of legal representation of clients across the Division during advocate absences. This may be accomplished by the Deputy Senior Staff Attorney temporarily providing direct representation of clients and/or coordinating coverage among other advocates .
KNOWLEDGES, SKILLS, AND ABILITIES REQUIRED : (These are required to successfully perform the work assigned).
+ Knowledge of laws, rules, regulations, policies, and procedures applicable to and enforced by assigned agency.
+ Knowledge of legal documents, court procedures, and rules of evidence.
+ Knowledge of the Administrative Procedures Act.
+ Knowledge of legal research principles, practices, and techniques.
+ Knowledge of modern management principles and practices.
+ Knowledge of Maine Performance Management and Appraisal System, applicable collective bargaining agreements, and Civil Service Rules.
+ Ability to understand and promote management goals as they affect day-day and long term operations.
+ Ability to supervise professional and non-professional staff.
+ Ability to advocate before administrative and public forums.
+ Ability to organize and implement legal administrative procedures and systems.
+ Ability to communicate effectively.
+ Ability to write clearly and effectively.
+ Ability to interpret and write laws, rules, and regulations.
+ Ability to research, analyze, and organize legal facts and principles.
+ Ability to use applicable computer programs.
MINIMUM QUALIFICATIONS
Admission to the practice of law in the State of Maine and current registration with the Board of Overseers of the Bar -AND- progressively responsible experience in the field of workers’ compensation benefits in providing legal representation to injured workers.
