The Director, Americas Privacy & Global Cybersecurity Counsel is responsible for leading the privacy legal support activities and privacy compliance efforts in the Americas region, as well as providing legal advice and counsel to the Company’s global cybersecurity function.

 

This position will be part of Dentsply Sirona’s global privacy team, and work closely and collaboratively with commercial and functional leaders within Dentsply Sirona, including from Information Technology, Information Security, Legal, Ethics & Compliance, Human Resources, Communications, Technology, and Procurement, as well as with outside counsel and consultants, among others.   

 

This position will report directly to the Vice President, Global Privacy Counsel & Data Protection Officer, based in the United States. This position is based in the United States and is a remote role.

 

Helps set privacy vision and strategy for the global privacy compliance program overall to align with business objectives and regulatory requirements. Establishes and communicates priorities for Dentsply Sirona’s Americas privacy compliance program on a quarterly and annual basis, as well as monitors and reports on progress toward those goals. Creates and maintains rationalized framework for privacy and cybersecurity compliance including tracking and analysing new privacy and cybersecurity regulations applicable to Dentsply Sirona’s Americas operations. Maintains and updates policies and procedures in response to new regulations, annually or more frequently as required, in partnership with the DPO. Working closely with Information Security, Procurement and Legal, develops and implements policies and procedures to effectively manage third party risk, including creating and maintaining contract template language, negotiation playbooks, serving as a point of escalation for privacy and cybersecurity questions, and advising on privacy and cybersecurity requirements for third-party audits and assessments. Sets training and awareness strategy and cadence for the Americas region based on regulatory requirements and compliance priorities, including leading the privacy strategy and content development for internal web pages and resources, creating and managing a privacy coordinator network for the Americas region, and hosting and presenting materials for regular engagement with the Americas privacy coordinator network. Designs and delivers privacy compliance training to the Americas region as well as globally as appropriate. Manages incident response process and events in the Americas region, including ensuring that procedures exist within the Americas region to promptly report data incidents to the privacy team, reviewing the Dentsply Sirona cybersecurity response plan and procedures to ensure that regional regulatory requirements are addressed appropriately, annually reviewing and refreshing incident response procedures and related documentation, maintaining breach notification requirements, and engaging in other incident response readiness activities. Implements notice and consent processes where legally required, including maintaining and updating privacy notices and working closely with the Dentsply Sirona corporate functions to  operationalize how notices are distributed and consents are obtained. Develops and documents procedures for fulfilling data subject rights requests, including training, avenues for submission of requests, communication to downstream processors where necessary, verification procedures, etc.  Manages responses to data subject requests (with support from other members of the privacy team and Dentsply Sirona corporate functions).  Leads data mapping strategy and execution for the Americas region based on regulatory requirements, risk and business needs. Working with the DPO and privacy team, implements appropriate procedures to ensure completion of Data Privacy Impact Assessments, including training and overseeing the completion of assessments and serving as the Subject Matter Expert for review and approval of assessments in the Americas region. Serves as the Subject Matter Expert for legally required technical and organizational requirements for the Americas region and maintains updated list of technical and organizational measures where required.  Helps set strategy and ensure legal compliance with respect to the Company’s use of Artificial Intelligence technology. Advises on and documents privacy-related procedures related to the use of Artificial Intelligence in the Americas region. Assists with conducting privileged assessments of privacy and security compliance for operations in the Americas region. Manages other member(s) of the privacy team as directed by the DPO.

Exprience:

Bachelor’s degree (or international equivalent) required. Juris Doctorate (or international equivalent) required. Relevant privacy certifications (e.g., CIPP, CIPM, CIPT, CHPS, CHPC, CISSP, ISEB) preferred, but not required. 10+ years’ experience in data privacy or related fields in a multinational environment, preferably in the life sciences/healthcare/medical device industry or another regulated industry. 3+ years’ experience working with data privacy laws in the U.S. and Canada. Knowledge of Latin America privacy regulations preferred, but not required. People management experience preferred, but not required.

 

Strong knowledge of and experience advising on the Health Insurance Portability and Accountability Act (HIPAA), and other data privacy laws and regulations and major data protection frameworks in the Americas region, particularly as they relate to health care data.  Working knowledge of and experience with the following data privacy laws and regulations is preferred: the US state privacy laws (e.g., CCPA/CPRA; VCDPA; CPA; UCPA; CTDPA); PIPEDA and other Canadian provincial data privacy laws; Brazilian Lei Geral Protectao de Dados Pessoais (LGPD) (LGPD), and other privacy laws in the Latin America region. Familiarity with medical device laws and regulations as they relate to data privacy and security such as the FDA and the FD&C Act is preferred but not required. Knowledge of information technology and data management systems. Ability to handle confidential and sensitive information with appropriate discretion. Experience interacting with technical teams and senior management and being a trusted business partner. Strong written, verbal and presentation skills, with the ability to express complex information and processes in a clear, concise and compelling manner. Solid analytical skills with the ability to respond to complex challenges with innovative solutions. Organized and detail oriented, with a high degree of ethics, integrity and professionalism. Highly motivated self-starter willing to meet strict deadlines and time constraints; must possess a positive, can-do attitude and show enthusiasm.
