About the Position: The Secretary of State, Bureau of Motor Vehicles, is seeking an experienced, detail-oriented professional for a fully remote Hearings Examiner position. In this role, the successful candidate will conduct hearings, evaluate and analyze complex cases, and make impartial decisions based on legal principles and procedural rules. The position involves managing a high volume of diverse cases, including those related to OUI, reinstatement after manslaughter, negligent operation resulting in death, and Lemon Law Arbitrations. As a Hearings Examiner, your decisions will be final and binding, with appeals limited to the Superior Court. The role demands exceptional communication skills, a commitment to fairness, and the ability to maintain composure in high-pressure situations. This fully remote position offers the flexibility to work from anywhere in Maine while operating independently and with minimal supervision. Additionally, the Bureau supports professional development by covering bar fees and continuing legal education (CLE) fees, ensuring that you stay current with relevant legal matters. Key Responsibilities: + Conduct Hearings: Schedule and conduct hearings primarily via Zoom, ensuring compliance with all relevant procedures and regulations. + Evaluate and Analyze Cases: Review case files, identify relevant legal issues, and analyze agency reports. + Make Decisions: Render impartial and informed decisions based on legal principles, facts, and procedural rules. Ensure decisions are fair and accurate, demonstrating decisiveness. + Communication: Communicate effectively with administrative staff, attorneys, law enforcement, and civilian witnesses, maintaining professionalism in all interactions. + Manage Complex Cases: Handle a high volume of diverse cases, including, but not limited to, OUI and refusal cases, reinstatement after manslaughter petitions, negligent operation resulting in death cases, and Lemon Law Arbitrations. + Maintain Composure: Demonstrate the ability to remain composed, professional, and objective during challenging and contentious hearings. + Policy and Procedure Compliance: Ensure hearings adhere to the Bureau’s policies, procedures, and relevant rules and laws. Preferences will be given to candidates who have: + Licensed and experienced in the practice of law. + Previous experience in a judicial, administrative, or legal setting, particularly involving the adjudication of complex cases. + A track record of making independent, well-reasoned decisions, showcasing decisiveness and fairness. + Experience managing high-volume caseloads in a professional and efficient manner Minimum Qualifications: (Entry level knowledges, skills, and/or abilities may be acquired through, BUT ARE NOT LIMITED TO the following coursework/training and/or experience). + An eight (8) year combination of training, experience, and/or education providing a working knowledge of the adjudication process relating to hearings.
