Yes County Albany Street Address 625 Broadway City Albany State NY Zip Code 12233 Duties Description This position performs duties under the supervision of higher-level Labor Relations staff in support of the NYSDEC Office of Employee Relations, Labor Relations Unit. Responsibilities include, but are not limited to:Provide assistance and guidance to managers and supervisors on various Labor Relation matters including contract interpretation and administration; policy interpretation; and best practices in approaching employee performance concerns ranging from time & attendance to incompetence and misconduct.Interpret terms of negotiated agreements, agency policies, attendance rules, and Civil Service Law and make recommendations to managers and supervisors in relation to the above.Assists with the development, review, and evaluation of labor relations policies and procedures.Assist with implementing disciplinary procedures on a consistent basis through preparation, formulated approaches, performing interrogations and thorough investigations. Advise managers of the purpose of discipline, progressive discipline techniques, disciplinary procedures, and provide guidance on practices such as effective and appropriate counseling. Assist with determining and taking action regarding claims of employee misconduct.Develop, draft and issue formal Notices of Discipline and associated records. Represent the NYSDEC as first and second chair at expedited arbitrations and full arbitration proceedings. This may include presenting oral and written statements and arguments, preparing witnesses for testimony and offering documentary evidence.Provide assistance and advice to management and supervisors regarding appropriate grievance and arbitration procedures. Act as a Management representative during grievance procedures and meetings, research grievances, and write comprehensive grievance decisions. Investigate incidents of workplace violence. Respond appropriately to workplace violence incident reports.Develop, conduct and participate in virtual and in-person training presentations.Participate in various committees representing management of NYSDEC. May supervise clerical or administrative support staff. Minimum Qualifications This title is part of the New York Hiring for Emergency Limited Placement Statewide Program (NY HELPS). For the duration of the NY HELPS Program, this title may be filled via a non-competitive appointment, which means no examination is required but all candidates must meet the minimum qualifications of the title for which they apply. At a future date (within one year of permanent appointment), it is expected employees hired under NY HELPS will have their non-competitive employment status converted to competitive status, without having to compete in an examination. Employees will then be afforded with all of the same rights and privileges of competitive class employees of New York State. While serving permanently in a NY HELPS title, employees may take part in any promotion examination for which they are qualified.Must have a valid driver’s license or demonstrate the ability to meet the transportation needs of the position. Travel may be required. Telecommuting may be available, Will be discussed at interview. Trainee 1: A bachelor's degree or higher-level degree.Trainee 2: A bachelor’s degree or higher-level degree and one year of professional labor relations experience; OR A Juris Doctor, master’s degree or higher in a field related to the position being filled.Journey Level, SG-18: A bachelor’s or higher level degree and two years of professional labor relations experience; OR a Juris Doctor, master’s or higher level degree in a field related to the position being filled and one year of professional labor relations experience.Candidates may also be eligible via the following:Reassignment - Currently in the title and an employee of DEC or Reinstatement Eligible - Previously held the title on a permanent competitive basis or held a title as indicated under the transfer eligible section on a permanent competitive basis.Eligible for transfer under Section 70.155 b/c appointment: Must meet the minimum qualifications outlined above.
