Legal Dispute Resolution Specialist

Job Purpose

Review and resolve disputes in a fair and equitable manner. Contribute to the safeguarding of the organisations reputation by mitigating risk, defending disputes and providing legal guidance to the business.

Responsibilities

Solutions Analysis

Analyse specific problems and issues to find the best solutions. Solutions could be technical or professional in nature.
Defend the organisation’s reasoning to the applicable platforms where and when required. Manage and maintain disputes including the drafting of legal responses, listening to evidence and making decisions regarding disputes; as well as the issuing of instructions to attorneys regarding summons received and all correspondence with attorneys where and when required.

Information and Business Advice

Provide specialist insight on the interpretation and application of policies and procedures, resolving queries and issues and referring very complex or contentious issues to others. Draft written communication to external platforms defending business' position.

External Platform Relationships

Liaise and ensure continuous communication on disputes referred to the applicable platforms on a verbal and written basis within the set time frames provided by their offices. Liaise with attorneys and/or applicable platforms to negotiate the best possible fee/settlement.

Internal Client Relationship Management

Build effective working relationships within the internal client organisation, delivering high-quality professional services with guidance from senior colleagues.
Build and maintain relationships within the organisation and applicable platforms.

Operational Compliance

Identify instances of non-compliance with the organisation's policies and procedures and/or relevant regulatory requirements, reporting these and escalating issues as appropriate.

Personal Capability Building

Develop own capabilities by participating in assessment and development planning activities as well as formal and informal training and coaching; gain or maintain external professional accreditation where relevant to improve performance and fulfill personal potential. Maintain an in-depth understanding of technology, external regulation, and industry best practices through ongoing education, attending conferences, and reading specialist media.
Ensure up to date knowledge of applicable platforms. Ensure up-to-date knowledge of organisational procedures and philosophies.
Keep abreast of all relevant legislation as well as best practice and apply accordingly.

Education

Grade 12/ SAQA Accredited Equivalent (Essential); Relevant Legal / LLB degree (Essential); STI Qualification (Advantageous); RE compliant (Advantageous); FAIS compliant (Advantageous)

Experience

3 years’ experience practicing as an attorney or advocate (Essential); Admitted as an attorney or advocate (Essential); 2-3 years’ experience in the insurance industry (Advantageous); Legal background within an insurance industry (Advantageous);
