Office of the Arkansas Lottery
Preferred Qualifications:
The formal education equivalent of a law degree from an accredited law school; plus six years of legal experience including one year of public sector law and one year as a legislative liaison. OTHER JOB RELATED EDUCATION AND/OR EXPERIENCE MAY BE SUBSTITUTED FOR ALL OR PART OF THESE BASIC REQUIREMENTS, EXCEPT FOR CERTIFICATION OR LICENSURE REQUIREMENTS, UPON APPROVAL OF THE QUALIFICATIONS REVIEW COMMITTEE. Preferred qualifications include experience as an attorney in a state agency, legislative experience, and supervisory experience. Must be licensed to practice law and admitted to the Arkansas State Bar per ACA 16-22-201.
Position Specifics:
Ensures OAL compliance with state and federal laws and regulations, including but not limited to the Arkansas Scholarship Lottery Act, Arkansas Freedom of Information Act, state procurement laws, the Administrative Procedures Act and all ethical rules and statutes; provides legal interpretation of the laws and regulations. Advises the OAL, its Director and management personnel on legal implications of proposed rules, policies and procedures, administrative decisions, and actions. Coordinates the filing of all documentation and reports which must be statutorily filed with the LOC. Promulgates all OAL rules in conjunction with the legislative legal committee and ensures that those rules are properly filed with the necessary agencies and are in compliance with state and federal laws. Provides assistance to the Director in formulating and interpreting policies and procedures. Drafts and interprets legislative bills, resolutions and amendments related to the Arkansas Scholarship Lottery Act. Reviews procurement contracts with OAL management and lottery vendors and reviews and advises on the terms of procurements recommended by the Director to ensure compliance with the Arkansas Procurement Code and the Arkansas Scholarship Lottery Act; develops contracts with lottery retailers and reviews the terms of the contracts. Represents the OAL in civil proceedings and administrative adjudication related to issues involving the day-to-day operations of the OAL. Supports the Director in response to public and media relations. Supervises and directs the activities of the licensing department staff and oversees the licensing of OAL retailers. Reviews all licensing applications for criminal and civil implications and makes recommendations to the Director regarding licensing approvals, suspensions or revocations. Conducts appeal hearings as necessary. Reviews and makes recommendations to changes to licensing rules and regulations. Develops processes to further the automation and efficiency of the licensing process. Assists the Investigations & Enforcement division with investigations of lottery theft and lottery fraud and serves as a liaison to local law enforcement and/or local prosecutor’s office in filing criminal charges. Performs other duties and oversees special projects as may be assigned by the Director.

Summary
The Lottery Office Chief Legal Counsel is responsible for directing the legal and administrative activities for the Office of Arkansas Lottery (OAL). This position is governed by state and federal laws and agency policy.
Functions

Serves as the OAL point of contact with the Arkansas Legislative Lottery Oversight Committee (LOC) and prepares and coordinates the filing of all documentation and reports which must be statutorily filed with the LOC. Promulgates all OAL rules in conjunction with the legislative legal committee and ensures that those rules are properly filed with the necessary agencies and are in compliance with state and federal laws. Provides assistance to the Director in formulating and interpreting policies and procedures. Drafts and interprets legislative bills, resolutions and amendments related to the Arkansas Scholarship Lottery Act. Reviews procurement contracts with OAL management and lottery vendors and reviews and advises on the terms of procurements recommended by the Director to ensure compliance with the Arkansas Procurement Code and the Arkansas Scholarship Lottery Act; develops contracts with lottery retailers and reviews the terms of the contracts. Represents the OAL in civil proceedings and administrative adjudication related to issues involving the day-to-day operations of the OAL. Serves as primary contact with outside law firms that are contracted to provide any legal support to the OAL. Provides information to the Arkansas Lottery Commissioners, legislators and their staffs regarding the OAL and its activities; supports the Director in response to public and media relations. Performs other duties and oversees special projects as may be assigned by the Director and the OAL Board. May organize and direct the activities of a legal and support staff. Performs other duties as assigned.

Knowledge of the state and federal laws, rules and regulations regarding lottery operations. Knowledge of state and federal laws, rules and regulations regarding administrative operations, including human resource management, procurement, contracts, freedom of information, administrative procedures, etc. Knowledge of legal research techniques and writing protocols. Knowledge of Office of Arkansas Lottery (OAL) organizational and operational structures and agency policies and procedures. Knowledge of the state's legislative process. Knowledge of supervisory practices and techniques. Knowledge of Microsoft Office (Word/Excel/Access/PowerPoint) and internet research tools. Ability to research, interpret, and apply state and federal legislation, rules, regulations, policies and procedures. Ability to draft legislative proposals, resolutions, amendments, rules and contracts. Ability to identify, research, and analyze problems or issues and propose solutions. Ability to prioritize a significant and diverse number of tasks. Ability to prepare, review and present oral and written information and reports. Ability to utilize Microsoft Office products and internet research tools. Ability to plan, lead, motivate, support, and supervise the work of staff.
