Summary About the Position: Incumbent serves as the Program Manager of the DHA Privacy and Civil Liberties Office (Privacy Office), overseeing the following programs: Health Insurance Portability and Accountability Act of 1996 (HIPAA), E-Government Act, Federal Information Security Management Act (FISMA), Privacy Impact Assessment (PIA), Civil Liberties, Privacy Risk Management Framework, and Data Sharing Agreements (DSAs). This position is located in either Falls Church, Virginia or San Antonio, Texas. Responsibilities In this high visibility position with very little room for error, you will function as the DHA expert on Privacy and the Health Insurance Portability and Accountability Act of 1996 (HIPAA) to set policy for all of the DHA. Oversee HIPAA Privacy Rule reviews of proposed research related data sharing activities. Review and implement System of Record Notices, Privacy Act Statements, and Privacy Advisories to ensure DHA’s information systems and electronic collections comply with relevant federal laws and regulations. Administer the Data Sharing Agreement (DSA) program to ensure any proposed use and/or disclosure of data is conducted in compliance with applicable federal and agency regulatory requirements. Manage a comprehensive privacy and security program to ensure compliance with the HIPAA Privacy, Security and Breach Notification Rules. Supervise the implementation of breach response reporting requirements pursuant to the HIPAA Breach Notification Rule. Handle DHA’s response to privacy-related, civil liberties, and/or Affordable Care Act related complaints from beneficiaries or the Department of Health and Human Services' Office of Civil Rights (HHS OCR) or workforce members. Lead the Health Information Privacy and Security Compliance Committee to oversee the status of compliance through collection/sharing of privacy and security related information and stakeholder communication facilitation. Coordinate Privacy Office participation in the Military Health System (MHS) Defense Business Transformation program to ensure privacy requirements are integrated into the life cycle of Defense Health Program funded systems. Shape the DHA’s privacy related input on the development and implementation of new data exchange initiatives. Exercise the full range of supervisory personnel management responsibility and authority in directing personnel in the DHA Privacy and Civil Liberties Office (Privacy Office). Specialized Experience: One year of specialized experience which includes interpreting Public Law in the management of a wide range of privacy compliance activities; evaluating the Health Insurance Portability and Accountability Act (HIPAA) or Privacy Act compliance programs within the Military Health System (MHS); reviewing uses and disclosures of Personally Identifiable Information (PII) and Protected Health Information (PHI) to ensure compliance with state and federal laws and regulations; and providing supervision, leadership, oversight or direction to employees and their work. This definition of specialized experience is typical of work performed at the next lower grade/level position in the federal service (GS-14). Some federal jobs allow you to substitute your education for the required experience in order to qualify. For this job, you must meet the qualification requirement using experience alone--no substitution of education for experience is permitted. You will be evaluated on the basis of your level of competency in the following areas: Attention to Detail Decision Making Managing Human Resources Problem Solving Time in Grade Requirement: Applicants who have held a General Schedule (GS) position within the last 52 weeks must have 52 weeks of Federal service at the next lower grade or equivalent (GS-14). Education Additional Information Male applicants born after December 31, 1959 must complete a Pre-Employment Certification Statement for Selective Service Registration. You will be required to provide proof of U.S. Citizenship. One year trial/probationary period may be required. Direct Deposit of Pay is required. Selection is subject to restrictions resulting from Department of Defense referral system for displaced employees. Recruitment incentive MAY be authorized for highly qualified candidates. Salary negotiation may be available for those candidates who are new to Federal service. Leave accrual negotiation may be available for those candidates who are new to Federal service. Student Loan repayment may be authorized. Salary includes applicable locality pay or Local Market Supplement.
