An established Oakland-based law firm is seeking a skilled Real Estate Litigation Attorney to join their team on a contract-to-hire basis. The ideal candidate will have experience managing complex real estate litigation cases, including disputes involving commercial and residential properties, landlord-tenant issues, construction defects, and contract disputes. This role offers the opportunity to work closely with a collaborative legal team on high-stakes real estate matters.
Key Responsibilities:
+ Handle a diverse caseload of real estate litigation matters, including property disputes, lease enforcement, and breach of contract claims.
+ Develop and implement legal strategies aligned with client goals.
+ Conduct detailed case analysis, risk assessment, and pre-litigation planning.
+ Draft, review, and file complaints, answers, counterclaims, and motions in compliance with California state and federal court rules.
+ Prepare dispositive motions, including motions for summary judgment, motions to dismiss, and other substantive legal documents.
+ Manage all aspects of discovery, including drafting and responding to requests for production, interrogatories, and subpoenas.
+ Conduct depositions of parties, witnesses, and experts to gather key evidence.
+ Review and analyze discovery materials to support case preparation.
+ Assist in trial preparation, including drafting trial briefs, creating exhibit lists, and preparing witnesses.
+ Work closely with the litigation team to ensure seamless case management and strategy execution.
+ Conduct thorough research on real estate laws, regulations, and case precedents in California.
+ Draft memoranda and reports to support legal arguments and case strategy.
Requirements
Qualifications:
+ Juris Doctor (J.D.) from an accredited law school.
+ Active member of the California State Bar in good standing.
+ Minimum of 1-3+ years of litigation experience, with a focus on real estate disputes.
+ Familiarity with California real estate laws, including landlord-tenant disputes, property rights, and zoning regulations.
+ Experience handling cases from pre-litigation through resolution, including trial preparation.
+ Strong understanding of California Code of Civil Procedure and local court rules.
+ Exceptional drafting and writing skills, including pleadings, motions, and discovery documents.
+ Proficiency in legal research tools (Westlaw, LexisNexis) and case management software.
+ Excellent verbal communication and negotiation skills.
+ Ability to manage multiple cases simultaneously in a fast-paced environment.
