The Department of Administration's Risk Management Division (RMD) (https://mn.gov/admin/government/risk/) operates Minnesota's state government's insurance program, along with the state workers' compensation and safety programs. We insure state vehicles for auto liability and auto physical damage and most state agencies for property and general liability. We serve the needs of state employees and agencies through full-service workers' compensation insurance (self-insured and self-administered), including disability management, return-to-work, and legal services. We also provide safety, loss control, risk, and insurance management consulting services to state agencies.
In this position, you will conduct all aspects of workers' compensation defense litigation, provide legal advice to workers' compensation claims specialists and state agencies, and other related issues. The overall purpose is to ensure that only legally compensable workers' compensation claims are paid and that agencies comply with the State statutes, regulations, and rules.
To promote a culture of flexibility, we offer staff a hybrid work environment that varies by team, position, and business needs. With a telework arrangement, onsite attendance may be required for team meetings or as requested by management to meet business needs. Completion of a telework agreement will be required.
In addition, traveling of up to 5% for in-person depositions; mediation sessions; and to the Office Administrative Hearings, Workers' Compensation Court of Appeals, Minnesota Supreme Court, or other locations will be required.
**Minimum Qualifications**
Applicants must possess a current license to practice law in the State of Minnesota and have at least five (5) years of workers’ compensation litigation experience representing employees and/or insurers/employers, which must include direct experience in workers’ compensation hearings and appeals.
Applicants who meet the above requirements will be further evaluated based on the following:
+ Thorough knowledge of Workers’ Compensation Law and other related legal areas.
+ Knowledge of medical terminology and understanding of medical conditions common in workers’ compensation disputes.
+ Knowledge of methods and resources available to research medical issues which do not occur regularly.
+ Skill in litigation and negotiation techniques.
+ Investigative and research skills in legal, medical, and other related areas.
+ Excellent written and verbal communication skills.
+ Interpersonal and human relations skills to be able to work with a variety of customers, stakeholders, and partners.
**Preferred Qualifications**
+ Demonstrate proficient knowledge of Minnesota based medical specialists available for independent medical examinations, use of vocational experts, and evaluation of functional capacity evaluation reports.
+ Demonstrate proficient knowledge and experience in creating litigation plans, conducting discovery, and being successful in workers’ compensation court proceedings.
+ Demonstrate proficient knowledge of representation on complex workers’ compensation claims, such as permanent and total disability claims, traumatic brain injury, and post-traumatic stress disorder related claims.
+ Demonstrate proficient knowledge in representing workers’ compensation cases at appellate levels.
+ Possess 10 or more years of Minnesota workers’ compensation law experience representing employees, employers and/or insurance carriers.
**Additional Requirements**
+ Successful applicant must pass a criminal background check and education/license verification through American Databank and employment reference checks prior to employment.
+ Must possess a valid driver’s license with acceptable motor vehicle record or have reliable transportation.
